Minutes of the meeting of Chipperfield Parish Council held in The Upper Parish Room at St Paul’s Church, Chipperfield on Monday
12th December 2005 at 8.00pm

Present Councillor Miss E.A Holliday (Chairman), Cllr M Bradshaw, Cllr M Jarrad, Cllr M Joseph and Cllr DJ Nobbs and Cllr R Wakeman.

AGENDA: Part 1

1. APOLOGIES FOR ABSENCE were received from Cllr B Berners-Price, Cllr J Carter and Borough/County Cllr R Roberts.

PC Heley and PCSO Ashworth were unable to attend as PCSO Ashworth had been nominated for an award. CPC wished her all the best, well deserved for all her hard work. They sent notification that since Nov there have been no reports of crime or disorder, but they had previously dealt some nuisance youths who had been invited to accept an ABC.

2 TO CONFIRM MINUTES OF THE MEETING HELD ON 14TH NOVEMBER. Item 186/05 should read “Herts CC not DBC”. Item 4 should read: PCSO not PSCO item 178/05 Queen Street.

3 PUBLIC PARTICIPATION
It was resolved that Standing orders be suspended in accordance with the provision of Standing Order 74 so that members of the public might speak

Mr J Peters and Miss McImerney present for planning application 04/02274/05/FHA. Mr Peters representing the applicants stated again the reasons why these were special circumstances. Chair advised Mr Peters that under Standing Order 34 “Rescission of Previous Resolution” a decision made by the council shall not be reversed within 6 months. Clerk confirmed with all members that they were satisfied no new information had been forwarded by the applicant and nothing had changed. All agreed. Chair therefore stated that the previous decision to recommend refusal remained.

A Finance and General Purposes-
196/05 Budget Proposal 2006-2007

Clerk circulated 2nd draft budget proposal for 2006/2007. Minor amendments were made to the preparation papers agreed by all. Clerk completed papers to DBC and they were signed off by Cllr Holliday, Cllr Bradshaw and Cllr Joseph and the Clerk in the presence of all members.

3. Sustainable Communities Bill
A letter had been received from David Gaulke MP, stating although he agreed there is an ongoing problem, he as present will not be signing their form. However he suggested we remain aware of ongoing issues that may affect the future.
4. Licensing
It was suggested that the Clerk draw up a spreadsheet of licensing hours and conditions for each public house within Chipperfield. It was agreed that a Cllr Check each of the public Houses and confirm a notice of their hours are displayed as required by law. Clerk to confirm with licensing the location required for display of notice.
5 Legal support/requirements
Clerk confirmed she have received a reply from NALC via HAPTC who claim they do not have prospectus but offer advice on any subject and could put us in touch with relevant legal representative should any matter go to court. It was suggested Clerk to pursue to obtain further details.
6 PCSO
It was agreed Clerk to write to Kim to congratulate her on her nomination, with a copy to her Sgt.
7 Fire Service.
It was agreed Clerk to write to Chief Fire Officer, Robert Ellis, David Lloyd and David Gaulke to ask what contingencies/cover were in place for Chipperfield, Bovingdon and surrounding area in the light of the Bouncefield incident and how it would have affected us had Bovingdon been closed.

B Highways, Road Safety and Public Transport

1 Tower Hill Footpath
Urgent gas works taking place for 2 weeks involving a road closure, Clerk to check with Highways regarding their reference to water works due to be carried out. Clerk to chase progress of footway.
2 Langley road – drainage flooding
Letter received in response to our safety concerns stating that remedial works due to commence Jan 06, any flooding to be reported by Clerk until works complete.
3 Gullies
No new date available, Clerk to chase new date now that the Nov deadline finished, also to chase “5 days works clearance orders to individual gullies” placed by Clerk.
4 Whippendell Hill Footway
Cllr Jarrad confirmed our legal papers were correct and accepted and we can now legally finalise the right of way across the farmer’s driveway at the bottom of the hill. Clerk confirmed Highways state there is a financial implication to CPC for the creation of a tarmac path extension at the bottom of the Jasmine track, all agreed that we may able to contribute some monies, Clerk to negotiate a lower cost with Highways and bring to council to discuss. All agreed that the kissing gate and sign posts to be arranged but put on hold until the completion of the path.

200/05 Planning Report

1. Three Rivers District Council Statement of Community Involvement.

As CPC is on the Three Rivers boundary, we are by statute required to be consulted on this third stage of consultation as to whom and how people should be involved in the planning process. It was recommended that are pleased to be consulted on their planning matters that could affect us, but note that contrary to the lists in Appendices A and C of their Statement of Community Involvement, we do not seem to have been consulted on the earlier stages. All agreed.

2. Development Sites in Chipperfield

As part of the procedure in developing a Local Development Framework, District Councils are required to identify potential development sites and draw up plans for them. In doing this they are required to consult local organisations. DBC has asked us to submit details of any we can identify. The Planning Working Party recommends we do not have any in the village, other than the Council-owned land at the end of Nunfield, which has already been nominated as a potential site for affordable housing. All agreed.

Clerk confirmed that she contacted the Spirit Group to expedite matters prior to contacting planning, to date no response. Clerk to contact DBC for advice.

Clerk confirmed all boards have now been installed. The board on the Common now contains the Parish map and a new version of heritage trail to be created and displayed

Cllr Holliday confirmed all legal details have been finalised. DBC suggest we now advise Ordinance Survey.

Clerk confirmed that the British Heart Foundation had now installed the banks at Wyevale. When full contact Clerk who will arrange for them to be emptied.

Production changes were agreed at the recent AGM. Copy will be sent to printers via email allowing for a later deadline, this will be on a trial basis until confirmed successful. Tenders will be put out for the creation of new advertising formats. A new financial Manager has now been elected.

8 Correspondence

Clerk distributed various new consultation papers relating to:-1) Proposed Luton Airport expansion 2) Boundary Committee 3) Statement of community involvement. A letter had also been received from Orange asking for suggestions in locating a mast site. All agreed no reply to be forward at this stage.

9 Accounts for payment
206/05 Schedule of payments

Clerk submitted a Schedule of Accounts to be certified for payment and it was RESOLVED that accounts totalling £4,232.06 be confirmed and certified for payment.
